    Sudans: Trench marks new border as rains approach

    America and other nations are trying to stop all-out war from breaking out between Sudan and the world's newest country, but the weather might do more to dampen hostilities.     Lingering disputes over borders, oil and other issues led to heavy battles last month that threaten to re-ignite a decades-long war that ended when a fragile peace was forged in 2005.
    Even the rains are unlikely to bring hostilities to a complete halt. Political leaders and some commanders in the southern military — the Sudan People's Liberation Army, or SPLA — note that troops can still march over the soggy ground and Sudan can still deploy bombers, which have been carrying out periodic air strikes.
    A military patch on Maj. Gen. James Gatduel Gatluak's sleeve shows the symbol of the 4th Infantry Division, and the reason the stakes here are so high: an oil well spouting black crude. The division is known as the SPLA Petrol Division.
    "I expect more attacks from Sudan. Even if they don't come themselves they can send militias or attack from the air. The rain, it can stop the fighting, but not always," said Gatluak whose face is a mask of tribal dots that is a tradition among the Nuer tribe.
    In recent weeks, Gatluak's men have shot down two Sudanese aircraft — a MiG fighter jet and a baby-blue unmanned spy plane that Gatluak said appeared to have been from Iran.
    When South Sudan broke away and became an independent nation last July, it took with it roughly 75 percent of Sudan's oil industry. Last month, SPLA forces moved into the oil town of Heglig, site of Sudan's last remaining large oil installation. Southern leaders say Heglig belongs to them even though a 2009 arbitration court ruling produced a map that showed Heglig remaining in Sudan, helping the country to cement its claim.
    But the south says a foundation stone laid by the British colonial government in 1956 proves Heglig is South Sudan's. Since the stone — if it exists — lies in territory controlled by the Sudan Armed Forces, the claim is difficult to prove.Air Jordan Womens sale online
    Sudanese forces advanced on Heglig after the south captured it, and the southern forces fled 10 days after taking it. The new frontline has now been pushed to the south, to Tachuien, a bare spot on a bare dirt road.
    About 60 kilometers (40 miles) to the southeast is Bentiu, the capital of Unity State. Bentiu has a single paved road. Large streetlights hang overhead but they haven't been lit since South Sudan shut down its oil production after it accused Sudan of stealing its oil.
    Life appears normal in Bentiu, even though its lone bridge — a strategic military crossing point — was targeted by Sudanese bombs last month that barely missed their target. Girls with baby-blue UNICEF backpacks walk the streets as U.N. vehicles rumble past. Trash — plastic bottles, mostly — is strewn everywhere. Six busted-up deep freezers are piled atop one another at one intersection.
    A handful of fighters from Sudan dart around in camouflage trucks. Chianjiek said they may be a part of an alliance of rebels known as the Sudan Revolutionary Front. Sudan has demanded that South Sudan stop assisting northern rebels.     The United Nations Security Council has told Sudan and South Sudan to stop fighting and return to talks or risk economic sanctions, something neither side can afford now that their respective oil industries have been crippled by the south's January shutdown. South Sudan can no longer sell oil, while Sudan is losing the transit fees it charged the south for moving oil through the northern pipelines.
    Both sides have indicated willingness to follow an African Union plan backed by the U.N. that demands a cessation to fighting and a renewal of talks, said AU spokesman Noureddine Mezni.
    South Sudan's oil fields — which provide 98 percent of the country's budget — are now eerily quiet. The Indian and Chinese engineers who ran the south's fields left weeks ago. Powerless high-tension lines run beside a dusty road, past mud and straw huts that provide precious shade from the scorching sun in the almost treeless, stark landscape.
    Somewhere to the north is the foundation stone, southern leaders insist, though even if the existence of the marker is proven it is unlikely to convince Sudan to give up its territorial claims.
    "The stone is somewhere in Kansana. We were in Kansana until late 2007. We didn't know Khartoum was going to claim that place to be the north's," said Michael Chianjiek, the deputy governor of Unity State.
    In an attempt to show that Heglig is the south's, Manyieuu Dak, the security adviser for Unity State, said that in his previous position as state health minister his workers carried out vaccinations in the Heglig region as recently as 2000.
    A former local politician said that when the south's forces captured Heglig, they "didn't burn the oil because it's our place."
    At the headquarters of the 4th Infantry Division outside Bentiu, Gatluak told a reporter on a recent day that all was quiet along the border. He noted that tanks can't cross the ditch at Tachuien, which was dug by Sudanese forces.
    He sat under a tree outside his office. A baboon wandered by and troops reached out and petted it. It was a tranquil scene, but Gatluak does not think it will last.
    Even if the situation quiets with the coming of the rains, they will end after a few months. The ground will dry up. Tanks and troop transport trucks will be able to move again.
    One year from now, Gatluak predicted, the war will be bigger and more intense.

    Hollande gets stormy welcome to power

    RAIN AND LIGHTNING
    Any indications on initial economic policy will be scrutinized both outside France and inside, where frustration over rampant unemployment and a sickly economy were key factors behind conservative Nicolas Sarkozy's defeat.
    For prime minister, he named former German teacher Jean-Marc Ayrault, a 62-year-old who has held elected public office since the mid-1970s, been a member of parliament since 1986 and met advisers to Germany's Merkel last year in an Endeavour to build ties with her conservative government.
    Hollande named as chief of staff Pierre-Rene Lemas, whom he has known since they attended the ENA civil service academy at the end of the 1970s. Lemas's deputy will be Emmanuel Macron, an investment banker in his 30s who will be an economic adviser.
    Hollande was officially sworn in a president just before 11 a.m. (0900 GMT) after Sarkozy greeted him on the steps of the Elysee and took him inside to hand over the country's nuclear codes and other secret dossiers.
    Anxious not to lose the "Mr Normal" image that appealed to voters tired of his showman predecessor, Hollande had asked for the inauguration ceremony to be kept as low-key as possible.
    He invited just three dozen or so personal guests to join some 350 officials at the event and neither his nor his partner Valerie Trierweiler's children attended the ceremony.
    Still, the man who until recently went to work on a scooter was presented with the official chain of office, a gold collar weighing nearly a kilograms and engraved with his name and the names of the six previous presidents of the Fifth Republic.
    After his rainsoaked victory lap, a sodden Hollande walked back up the red-carpeted Elysee steps to eat his first lunch as president with a group of former Socialist prime ministers.

    Cruise line sued for failing to rescue fishermen

    Vasquez and two friends, 16-year-old Fernando Osorio and Oropeces Betancourt, 24, were adrift after losing power aboard the small boat in which they had embarked from Rio Hato, Panama, on February 24 on a commercial fishing trip.
    The vessel, called the Fifty Cents, had been adrift for 15 days when it came within sight of the Star Princess, a luxury cruise ship operated by Princess Cruises, the lawsuit says.
    Three Star Princess passengers spotted it and alerted a crew member to the vessel, as Vasquez and his friends waved their arms and a shirt tied to a pole to signal they were in distress, according to the lawsuit.
    It contends that the cruise ship refused to offer any assistance, however, failing to alter its course and sealing the fate of two young men who died what were otherwise avoidable deaths.
    The lack of help was despite the fact that the crew member who "visually confirmed the distressed boat for himself" was alleged to have reported the emergency situation to the cruise ship's bridge and other Princess employees, the civil complaint says.Save on Nike Women's Running Shoes
    Osorio died about 24 to 36 hours after the Star Princess sighting, according to Manuel Epelbaum, an attorney for Vasquez. He said Osorio's death was followed within a matter of days by that of Betancourt.
    "They're claiming the captain didn't know," Epelbaum told Reuters, referring to a statement issued by Princess Cruises on Monday.
    "We're questioning whether that is even true," he said.
    Princess Cruises, a unit of global cruise industry giant Carnival Corp, said it was still investigating the Fifty Cents incident and the claim that Star Princess failed to come to the aid of the disabled fishing boat.

    But the cruise line, which is based in Santa Clarita, California, blamed an apparent breakdown in communication through the chain of command on the cruise ship.

    "This is an upsetting and emotional issue for us all, as no employee onboard a Princess ship would purposefully ignore someone in distress," the statement added.     Vasquez was rescued 13 days after being sighted by the Star Princess passengers by another fishing boat near the Galapagos Islands, according to the lawsuit.
    It asserts that the trio of passengers who witnessed the distressed vessel followed up with a Star Princess officer, two days after the sighting, but the officer walked away without offering any explanation.
    "This incident was once again reported to an officer of the Star Princess who continued the pattern of callous disregard for human life," the complaint says.
    "This pattern of conscious neglect further evidences Princess' outrageous conduct and their complete disregard for the lives and safety of the men who were adrift at sea," it says.
    Princess Cruises did not return a call seeking comment on the Fifty Cents case.
    Epelbaum said the Star Princess' failure to rescue people lost at sea violated general maritime law and several international treaties or conventions. But maritime legal experts say enforcement of such laws or obligations is limited, often falling to the flag state of the ship in question.
    The Star Princess is registered in Bermuda under the so-called "flag of convenience" system, which allows U.S.-based cruise ships to avoid many U.S. taxes and labor and safety laws.

    Nassau County seeks $41 million for tax refunds

    The money, needed to pay tax refunds to homeowners, cannot be raised in financial markets because Democrats, who are in the minority in the legislature, oppose a $71 million borrowing plan, county officials said on Tuesday.

    While Republicans and Democrats have been wrestling for months over Nassau County's tattered finances, a legal freeze of its bank accounts would affect the county's daily operations, potentially hitting services and payroll.
    The county, located on the western half of Long Island and home to 1.33 million people, is one of many around the United States struggling to balance its budgets.
    Nassau County's recent fiscal problems are at odds with the wealth of its taxpayers, who have a median household income of $93,613, well above the national average.
    The county has a long history of mismanaging its finances. It was put under state control after New York gave it $100 million of aid in 2000 to ward off a possible bankruptcy.

    PGA Tour refuses to take stance over Augusta membership

    Augusta National's membership policy came under fire during last month's Masters tournament with club chairman Billy Payne refusing to discuss whether change was on the agenda.

    "We don't get to determining whether their policies are right or wrong because we don't have to, because we made the conclusion that regardless of those policies, we are going to continue to play and recognize them as part of the PGA Tour," Finchem said at a news conference ahead of Thursday's first round of the Players Championships.
    "I know some people don't like that position and I appreciate that and understand their reasoning but that's the decision we've made."
    However, Finchem said the PGA Tour's approach to regular venues was demanding of open-membership policies.
    "The position of the PGA Tour hasn't changed. We have a policy that says that when we go out and do a co?sanctioned event, we are going to play it at a club that is as open to women members, open to minority members etc and we follow that policy carefully," said Finchem.
    "In the case of the Masters, we have concluded a number of times now that we are not going to give up the Masters as a tournament on our tour. It's too important and so at the end of the day, the membership of that club have to determine their membership. They are not doing anything illegal."
    Augusta National's membership policy has been an issue for years but it took on added significance after Ginni Rometty became chief executive officer of IBM in January.
    IBM, the world's largest technology services company, is a long-standing sponsor of the Masters and its past four CEO's were granted membership to Augusta National.
    But the club now faces a dilemma of whether to change its policy to allow Rometty to join or spurn one of its major sponsors.Jordan Shoes
    U.S. President Barack Obama stepped into the debate during the build-up to the tournament.
    "His personal opinion is that women should be admitted," White House spokesman Jay Carney told reporters last month, saying he had spoken to Obama about the issue. "We are kind of long past the time when women should be excluded from anything."
    Payne has followed the long-standing Augusta National policy of declining to discuss membership issues.
    Augusta's invitation-only membership has been steeped in secrecy since the conservative club opened in 1932. Women are allowed to play the course if invited by a member but cannot become members themselves.
    The club does not reveal its full list of members, believed to be around 300, although it is known that some of the most powerful men from industry and finance, including Bill Gates and Warren Buffett, are members.

She has detailed her nightmarish experience in her new book Hot Cripple: An Incurable Smart-Ass Takes on the Health Care System and Lives to Tell the Tale, which is based on her award-winning one-woman show.
    In 2004 she was an ex-model and struggling actress who was waitressing to pay the bills.
    "I did not have insurance because I could not afford it," she says. "Between rent and eating in New York City and the night club I worked in did not offer health insurance."
    One day while walking to her waitressing job in downtown Manhattan a speeding car barreling toward her at 40 miles per hour hit her. Her head took out the entire windshield and she was rushed to the emergency room.
    Because she did not have health insurance she did not get very good care at the emergency room. "Once they found out I did not have insurance I was basically ignored," she explains. "I had to beg for a CAT scan of my head and the man in the bed next to me who had only fainted during dinner whose CAT scan came back fine was kept over night for observation. Everyone was paying attention to him and I was released with a neck brace and a 'good luck'."

    Her injuries included five herniated discs, a sever concussion which caused short-term memory loss, vision and balance problems, two torn ligaments and a chunk off the back of her knee cap.

"I had to find a lawyer before any doctor would see me to be covered by that but they can cut you off at anytime, which they ended up doing."
    She was in constant physical and financial pain.
    "I couldn't work and went through what little savings I had and maxed out my credit cards," she says. "[I] ended up on food stamps and Medicaid and disability and I had to borrow money from these loan shark type companies that loan people money against their settlements because I had to survive."
    It has taken Gorman several years to recover and unlike many, she's been able to overcome her dire circumstances and make lemonade out of lemons, so to speak.
    While she does believe the Affordable Care Act is a step in the right direction, she believes a lot more has to be done to fix the health care crisis in this country.
    "I'm not hearing anything from the insurance companies about how they are going to make it more affordable so that every American can get health insurance," says Gorman. "Health care shouldn't be a luxury that only some can afford."

    Stocks rebound on hopes of further Fed stimulus

    The euro, which was also supported by data from Germany showing business morale rose unexpectedly for a fifth successive month in March, climbed to its highest in a month before easing to trade steady on the day around $1.3350.
    Commodity-linked currencies, hit hard last week by growing fears of weaker Chinese demand for resources, also gained. The Australian dollar popped back above $1.05, well off last week's low of $1.0333.
    "As participants cautiously price more QE back into markets, the commodity currencies -- the Australian, Canadian, and New Zealand Dollar -- are likely to attract attention given their high yields relative to the U.S. dollar," said Christopher Vecchio, currency analyst at DailyFX.
    Commodities were mostly steady, after gains in the previous session on Bernanke's comments, supported by the weaker dollar which encourages purchases of dollar-denominated commodities by holders of other currencies.

    "I would want to use this opportunity to apologize to all of beneficiaries who believed in our funds and purchased them," Asakawa told a financial committee of parliament.
    Pensions are a sensitive political issue in Japan, a rapidly ageing society that is grappling with how to pay for its swelling population of retirees.
    Asakawa said he personally produced a falsified investment report by inflating the asset size and investment results to cover up the fact that his fund was running at a loss.
    "I didn't want to return the money to clients at a loss," said Asakawa, who was dressed in a dark blue suit, responding to a question from the committee.
    "I'm deeply sorry, but I had absolutely no intention to cheat our clients from the beginning."
    LOSSES FROM 2009
    The Securities and Exchange Surveillance Commission (SESC) found AIJ's investment loss totaled 109.2 billion yen ($1.32 billion) from equity and bond derivatives trading conducted between 2002 and 2011.
    During the nine-year period, AIJ collected about 145.8 billion yen, mostly from small companies that entrusted their pension funds to the asset manager.
    The FSA stripped AIJ of its registration as a discretionary asset manager last week as it was unable to account for most of its assets under management and had falsified its report to investors.
    AIJ's funds started to suffer losses from around April 2009 and the losses got bigger by March 2010, but the funds had recorded positive returns after the Lehman shock in late 2008, Asakawa said.

    Asakawa's basic investment strategy was to bet against the market trend by shorting JGBs, betting that yields would go up, the SESC said.

    Asakawa received about 70 million yen in salary each year, he said.

    Former U.S. Rep. Jefferson loses appeal on bribery convictions

    The case gained notoriety when FBI agents, in a search of Jefferson's residence, found $90,000 neatly wrapped in foil and stashed in freezer of his home.
    A federal jury in 2009 found Jefferson guilty of 11 of 16 charges, including soliciting bribes, depriving citizens of his honest services, money laundering and participating in a racketeering enterprise. He was sentenced to 13 years in prison but remained free pending his appeal.
    Seeking to overturn his convictions, Jefferson argued that he never performed official acts in exchange for payment. He claimed the trial judge erred by instructing the jury that an "official act" could include the customary practices of public officials rather than the specific legislative duties of Congress members, such as voting or introducing legislation. But the appeals court rejected that argument.
    "There was, in this case, an ongoing course of illicit and repugnant conduct by Jefferson - conduct for which he was compensated considerably by those on whose behalf he was acting," Judge Robert King wrote for the panel.cheap jordan shoes
    The court did overturn one wire fraud conviction, ruling the charge should not have been prosecuted in Virginia federal court because it involved a phone call from Africa to Kentucky.

    A ruling, expected in late June before the Democratic and Republican party conventions, is likely to become a flashpoint in the November 6 presidential and congressional elections.
    The court's ruling on the insurance requirement could decide the fate of the massive multi-part healthcare overhaul meant to improve access to medical care and extend insurance to more than 30 million people.
    On Monday the justices took up a procedural tax-law question about the timing of lawsuits and suggested by their questions that they could decide the merits of case.
    The centerpiece of the Affordable Care Act is the mandate that most people buy health insurance by 2014 or pay a tax penalty. The challengers, including 26 states and a small-business trade group, contend Congress exceeded its authority to regulate commerce with that so-called individual mandate.
    In more practical terms, the challengers say that if the government can force people to enter the insurance market, it would have latitude to force people to engage in other behavior, whether it be to buy American-made cars or, in a mantra of the current litigation, to eat broccoli.

    COURT DIVISIONS
    The Supreme Court is deeply split on ideological and political grounds, with the five conservative Republican-appointed justices often in the majority: Chief Justice John Roberts and Justices Antonin Scalia, Anthony Kennedy, Clarence Thomas and Samuel Alito.
    The four liberal Democratic appointees are Justices Ruth Bader Ginsburg, Stephen Breyer, Sonia Sotomayor and Elena Kagan.
    A looming point of interest for the 400 spectators who will crowd into the courtroom on Tuesday is whether that 5-4 division becomes evident or appears to splinter.
    All four liberals are likely, based on their past decisions and statements, to vote to uphold the law. If that occurs, they would need only one of the conservatives for a majority. An American Bar Association legal group survey of academics and lawyers found that 85 percent thought the law would be upheld.
    Among the justices most likely to become swing votes in the dispute are Roberts, a 2005 appointee of President George W. Bush who has often deferred to Congress in rulings and has signaled an interest in avoiding a deeply divided ruling.
    Another conservative justice who could defy political-based assumptions is Anthony Kennedy, a 1988 appointee of President Ronald Reagan. Kennedy has straddled the middle and has most often been the swing vote when the liberals prevailed.
    Based on his opinions, Justice Clarence Thomas is most likely to vote to strike down the law. Justices Scalia and Alito cannot be as easily predicted as Thomas.
    CONGRESS VERSUS THE STATES
    U.S. Solicitor General Donald Verrilli, the administration's top lawyer at the court, will argue that the individual mandate flowed naturally from Congress's authority to regulate commerce, including its longstanding authority in the insurance field.cheap jordans for sale
    In his brief to the justices, Verrilli said the law addresses an existing problem in the healthcare market brought on by the uninsured consuming health care they cannot afford.

    Clayton spoke before Sanford's police chief and a local prosecutor stepped aside Thursday. The chief was accused by critics of mishandling the investigation of 17-year-old Martin's death.
    "I do this in the hopes of restoring some semblance of calm to a city which has been in turmoil for several weeks," Police Chief Bill Lee Jr. said.
    The U.S. Department of Justice has launched a civil rights probe and a special prosecutor appointed by the governor is examining the February shooting by watch captain George Zimmernan, 28.     The failure to arrest Zimmerman — who said he shot in self-defense after Martin attacked him — and a delay in releasing 911 calls related to the shooting outraged Sanford residents who called it the latest example of bias against blacks.

    Residents had demanded that Lee be fired before he stepped down; afterward, protesters gathering early for a rally chanted "The chief is gone. Zimmerman is next." Others sold T-shirts that read, "Arrest Zimmerman." Lee has said police officers didn't arrest Zimmerman immediately after the Feb. 26 shooting because he claimed self-defense and there was no evidence to contradict his claims. Florida's self-defense law gives people wide latitude to use deadly force rather than retreat during a fight.
    Lee has been on the job for less than a year. His predecessor, Brian Tooley, retired early in wake of criticism that Sanford police dragged its feet in arresting Justin Collison on charges of knocking out a homeless black man.

    The department was also criticized for delaying the arrest of two security guards with close ties to the department who shot a 16-year-old teen to death in 2005. The guards were arrested several months after the shooting and were eventually cleared.
    One of the two guards who shot Travares McGill was a police volunteer and the other was the son of a former police officer. Bryan Ansley and William Swofford claimed they feared for their lives when they shot the teen through a car window.
    Of Sanford's 53,000 residents, 57 percent are white and 30 percent are black.
    Some residents have proposed boycotting the Sanford Police Department by asking 911 dispatchers to send county sheriff's officers rather than the Sanford police.
    And Martin's family said the resignations don't' go nearly far enough. They repeated demands Thursday that Zimmerman be charged.
